The practice is led by Rachelle Rosenberg, who has more than two decades of experience handling commercial real estate matters including real estate litigation, commercial foreclosure, construction-related agreements, construction access disputes and RPAPL § 881 proceedings. The team’s experience also includes partition actions, boundary and easement disputes, construction-related claims, mechanic’s lien matters, title and deed disputes, landlord-tenant conflicts and commercial foreclosure proceedings.

Construction and development projects in New York frequently require temporary access to neighboring property. Abrams Fensterman represents developers seeking construction access and adjoining property owners seeking appropriate protections.

Our attorneys negotiate construction license and access agreements involving scaffolding, sidewalk sheds, façade work, underpinning, foundation work, monitoring equipment, roof protections and temporary encroachments. One Integrated Real Estate Practice

Commercial real estate matters rarely fall neatly into a single legal category. An acquisition may depend on financing and joint-venture arrangements. A development project may require leases and access to adjoining property. A financing relationship may later result in a workout, foreclosure or other dispute. Agreements negotiated at the beginning of an investment can ultimately become central to litigation.

Abrams Fensterman’s Real Estate practice is structured to address those connections. The practice is overseen by Mark Caruso from the firm’s Brooklyn office. Transactional and financing matters are led by Elliot Steinmetz, while Rachelle Rosenberg leads the firm’s Real Estate Litigation practice, including commercial real estate disputes, foreclosure and construction-access matters.

→ Represented a client in the acquisition of a controlling membership interest in a major development project joint venture in Long Island City, New York, followed by a $70 million construction loan and subsequent $85 million refinancing.
→ Represented a purchaser in the $85 million acquisition of a multifamily portfolio in Alabama and related financing.
→ Represented a bridge lender in connection with an approximately $75 million structured financing facility collateralized by properties and equity interests in multiple states.
→ Represented a joint-venture purchaser, including a 1031 investor group, in the $72 million acquisition of a multifamily portfolio in Delaware and related financing.
→ Represented a purchaser in the $48 million acquisition of a nursing home portfolio in Florida and related financing.
→ Represented a landlord/seller in connection with a $30 million lease with an option to purchase a mansion in Southampton, New York.
→ Represented a seller in the $20 million sale of a multifamily portfolio in New Jersey, including the assumption of senior and mezzanine financing.
