Rachelle Rosenberg

Rachelle Rosenberg is a Partner and Director of the Real Estate Litigation Department at Abrams Fensterman, LLP and an experienced New York real estate and commercial litigator. For over 20 years, Rachelle has represented developers, property owners, contractors, businesses, and individuals in construction license agreements, adjoining-property access disputes, RPAPL § 881 proceedings, and other complex real estate matters. She currently handles a substantial portfolio of over 100 construction license agreement matters throughout New York City.

Rachelle regularly drafts and negotiates construction access and neighbor license agreements involving scaffolding, sidewalk sheds, façade work, underpinning, excavation, property protections, insurance, indemnification, access fees, and project scheduling. When the parties cannot reach a negotiated agreement, she represents both developers seeking access and adjoining property owners protecting their property rights in contested RPAPL § 881 proceedings.

Her broader real estate litigation practice includes landlord-tenant proceedings, commercial lease and lease-renewal disputes, construction defects, cooperative and condominium disputes, sponsor litigation, and partnership disputes involving real estate. Rachelle also handles complex commercial litigation in New York state and federal courts, as well as arbitrations, mediations, and regulatory proceedings.

Although a fierce advocate, Rachelle approaches litigation with the perspective of a businessperson. She works to understand each client’s practical and financial objectives and frequently employs negotiation, mediation, and other forms of alternative dispute resolution to reduce the cost, delay, and disruption associated with protracted litigation. She is responsive and attentive to every client, whether representing a large corporation, a real estate developer, or an individual property owner.

In June 2014, Rachelle and Elliot Steinmetz founded Rosenberg & Steinmetz PC, where she developed a team of attorneys focused on construction license agreements and RPAPL § 881 proceedings in New York City. Rosenberg & Steinmetz joined Abrams Fensterman in 2026, expanding the firm’s capabilities in real estate, commercial litigation, and outside general counsel services.

Rachelle began her legal career as a litigation associate at a prominent New York law firm. There, she represented major corporations in a broad range of complex commercial disputes in federal and state courts, regulatory proceedings, arbitrations, and mediations. She later joined a smaller firm, where she developed her concentration in real estate-related disputes and construction access matters.

Rachelle earned her Juris Doctor from Fordham University School of Law, where she was a member of the Fordham Urban Law Journal and an editor of the Fordham Sports Law Forum. She earned her Bachelor of Arts from Brooklyn College.

Rachelle is admitted to practice in New York and New Jersey, as well as before the United States District Court for the District of New Jersey and the Southern and Eastern Districts of New York.
