Abrams Fensterman Achieves Favorable Resolution in Major Music Copyright Infringement Matter on Behalf of BMG Rights Management Against MGA Entertainment

What Happened
MGA Entertainment launched a national advertising campaign for its Poopsie Slim Surprise toy line featuring a dancing unicorn. The campaign used an original song titled “My Poops,” which closely mimicked the melody, structure, and style of the Black Eyed Peas’ hit “My Humps”, a work in which BMG holds significant rights. MGA did not secure the necessary licensing or permission, leading BMG to file suit in the U.S. District Court for the Southern District of New York.
