Brian A. Bloom is a Partner at Abrams, Fensterman, Fensterman, Eisman, Greenberg, Formato & Einiger, LLP and Director of the firm's Entertainment and Intellectual Property Practice Group.
Mr. Bloom concentrates his practice on complex commercial litigation, entertainment and intellectual property matters. Mr. Bloom counsels fortune 500 companies, major record companies, concert tour promoters, individual entertainers, musicians, photographers and authors with respect to a diverse range of intellectual property matters. In addition, Mr. Bloom represents several major merchandising companies with respect to entertainment related litigation and complex corporate transactions involving intellectual property issues. His practice includes representation of a variety of clients in civil litigation involving claims of copyright and trademark infringement, counterfeiting, trade dress, false advertising, unfair competition, right of publicity, privacy, and defamation. Mr. Bloom has pursued cybersquatters in both federal court and in ICAAN arbitration proceedings.
In addition to his sophisticated litigation practice, Mr. Bloom counsels clients concerning the risk assessment issues involving trademark and copyright use and licensing, branding, marketing partnerships and sponsorship agreements. Further, Mr. Bloom has experience negotiating and drafting recording and publishing agreement, software license agreements, joint venture agreements, synch license agreements, ringtone and mastertone license agreements, trademark licensing agreements, film finance and option agreements, as well as, reality television participation and development agreements.
Mr. Bloom regularly serves as a panel lecturer on various intellectual property issues. In addition, he co-authored the cover article in the April, 2006 issue of industry publication IP Today, entitled "Online Retailer Liability - The DMCA Defense."
Mr. Bloom received his BS from Cornell University, with distinction, in 1999. He received his JD, magna cum laude, from Hofstra University School of Law in 2002. Mr. Bloom is admitted to practice law before the courts of the State of New York, all four New York Federal District courts, the District of Columbia and the Second Circuit Court of Appeals. He is a member of the New York State Bar Association's Committee on Entertainment, Arts and Sports Law, as well as an active member of the Copyright Society of the U.S.A.
